Requirements for Authorized Contractors

1) If the authorized contractor agrees to construct a unit for a customer and fails to object to any part of the requirements listed in The Bill of Rights, the manufacturer waives their right to object at a later date and waives legal recourse against The Toy Lot.com, Cowboy Cadillac or RV Truck and the customer. The contract is considered in effect when a check is cashed from The Toy Lot.com, Cowboy Cadillac or RV Truck, without exception.

2) The authorized contractor must supply each customer a catalog listing all suppliers of parts used to construct the Toter and or Motorhome. This catalog must include part numbers.

3) The authorized contractor must supply each customer a complete wiring diagram of wiring used in the construction of the customer’s Toter or Motorhome.

4) When the authorized contractor signs a check or a contract supplied by The Toy Lot.com, Cowboy Cadillac or RV Truck and the customer agents, the manufacturer accepts the manufacturing agreement listed on this document. This Bill of Rights can be found for public inspection on The Toy Lot.com, Cowboy Cadillac or RV Truck and the customer web site /billofrights.htm

5) If an authorized contractor fails to provide this Bill of Rights to The Toy Lot.com, Cowboy Cadillac or RV Truck and the customer, the customer, vendor and/or manufacturer shall have no legal recourse. Any legal fees arising from this shall be paid in full by the vender and/or manufacturer. If the manufacturer or vendor cashes a company check, they have agreed to the terms listed on the Bill of Rights page. Any contractor who agrees to manufacture a conversion for a customer supplied by our companies shall put the customer before profit. The conversion shall cost in parts and labor equal 2/3rd of the contract price. NO SHORT CUTS OR LESS EXPENSIVE PARTS AND MATERAILS SHALL BE USED TO GENERATE A HIGH PROFIT MARGIN FOR THE CONTRACTOR! The customer shall retain a copy of the signed contract in case of disputes. If the customer has lost a contract or the contract was lost in fire or storm we shall not replace a copy.

 

 

6) The authorized contractor and/or manufacturer shall sign and return a final bid before the vendor signs a contract with a client supplied by The Toy Lot.com, Cowboy Cadillac or RV Truck and the customer. If the vendor does not return this contract and agrees to manufacture a unit for a customer, the vendor and/or manufacturer shall assume all financial liability and terms listed above without recourse.

Funding

7) When a authorized contractor, manufacturer or vendor building a conversion, agrees to build a unit, the owner of and/or owners and/or authorized contractors, manufacturers, venders agrees to allow The Toy Lot.com, Cowboy Cadillac or RV Truck and the customer to collect a deposit from the customer. The authorized contractor, manufacturer or vendor building a conversion shall not fund personal bills or other customers conversions with the funding from our customers.

 8)The Toy Lot.com, Cowboy Cadillac or RV Truck shall collect a deposit, plus the profit margin for The Toy Lot.com, Cowboy Cadillac or RV Truck for the customer’s conversion.

 

9) The authorized contractor or manufacturer building a conversion for a customer shall agree to collect the remaining funding from the customer. The authorized contractor or manufacturer building a coach shall agree to complete and deliver the unit before requesting final payment. The conversion company shall purchase the chassis and all materials. The authorized contractor, manufacturer and/or vender building a coach for Cowboy Cadillac shall keep the Cowboy Cadillac account current. If the authorized contractor is more then 30 (Thirty) days late on funding sales or commission for sales, Cowboy Cadillac shall reserve the right to hold any deposit until the outstanding balance is paid in full. The authorized contractor, manufacturer and/or vender building a coach are solely responsible to refund the customer or pay the outstanding sales commission. The vendor and/or manufacturer shall assume all financial liability and terms listed above without recourse.

 

10) Final payment for said project shall be paid in full within 10 days after customer approves the project and accepts delivery. Once a conversion has been delivered to the person funding the conversion, they shall be issued a MSO (Manufactures Statement Of Origin).No authorized contractor, vender and/or manufacturer can issue a MSO for The Toy Lot.com, Cowboy Cadillac or RV Truck and the customer. If the customer refuses said conversion and repairs are not completed, The Toy Lot.com, Cowboy Cadillac or RV Truck shall retain the right to hold the deposit until the problem is resolved.

 

11) When an authorized contractor or manufacturer building a conversion for a customer agrees to build a unit using the label name, the manufacturer shall agree that any additional sales generated by The Toy Lot.com, Cowboy Cadillac or RV Truck and the customer either directly or indirectly shall remain a sale of The Toy Lot.com, Cowboy Cadillac or RV Truck. If The Toy Lot.com, Cowboy Cadillac or RV Truck and the customer and/or sale lead creates additional sales for the authorized contractor, vendor and/or manufacturer, the customer’s sales lead must be sent directly to The Toy Lot.com, Cowboy Cadillac or RV Truck and the customer within 24 hours.

 

12) If the authorized contractor or manufacturer fails to provide the lead directly to The Toy Lot.com, Cowboy Cadillac or RV Truck and the customer, the authorized contractor or manufacturer is in breach of the agreement. Furthermore, the authorized contractor or manufacturer shall waive any right to funding being held on current construction projects until the additional sale and/or sales are final. The Toy Lot.com, Cowboy Cadillac or RV Truck and the customer shall receive 30% of the gross sales price as a commission from authorized contractor, vender and/or manufacturer. The Toy Lot.com has the right under this contact to impose a $300.00 a day late payment charge. In any case, The Toy Lot.com, Cowboy Cadillac or RV Truck and the customer shall receive the conversion at 0 (Zero) additional cost. Any dispute shall be made in writing. The dispute shall be mailed certified delivery via The United States Postal Service. The dispute shall be mailed to The Toy Lot.com, Cowboy Cadillac, or RV Truck for the mailing address. If the authorized contractor or manufacturer fails to follow these guidelines and creates additional charges for The Toy Lot.com, Cowboy Cadillac or RV Truck and the customer, the authorized contractor or manufacturer shall be held liable for lose of funding.

 

13) If the authorized contractor, vender, manufacturer and/or customer creates or makes a deal outside if these guidelines in a effort to deny, defraud or eliminate the profit margin to The Toy Lot.com, Cowboy Cadillac or RV Truck, the authorized contractor, vender, manufacturer and/or customer waives their rights to their contract under this agreement. Furthermore The Toy Lot.com, Cowboy Cadillac or RV Truck and the customer and owners shall not be held liable for lose of funding and/or property due to outside deals.

 

13a) If the authorized contractor, vender and/or manufacturer has funding from our customers, they must maintain the funding in an escrow account. The authorized contractor, vender and/or manufacturer can only spend the money on our customer’s coach. At any time, the customer or our company can demand a full accounting and proof of deposits. If the deposits do not match the funding spent to date, the contract will be terminated. The authorized contractor, vender and/or manufacturer shall refund the remaining balance to our company with 10 days. The Toy Lot.com has the right under this contract to impose a $300.00 a day late payment charge. The authorized contractor, vender and/or manufacturer agrees to terms and conditions found on the Bill of Rights page. If the authorized contractor, vender and/or manufacturer agree to build a conversion or any product, they have waived all rights to a signed contract by cashing a check from our companies. Cashing a check from our company states they have read and agreed to all terms, without exception, listed on our web site. If the authorized contractor, vender and/or manufacturer have cashed the check without written objection to the Bill of Rights, the contract shall be legally binding!

The Toy Lot.com, DBA RV TRUCK and Cowboy Cadillac.com is a creative marketing approach to the modern search engine. Use of the web site by retail customers and authorized contractor constitutes acceptance of everything stated, without recourse. The Toy Lot.com, DBA RV TRUCK and Cowboy Cadillac.com does not manufacture hauler beds or complete trucks nor does The Toy Lot.com manufacture RV Truck conversion. This Creative Approach is to assist RV Truck and Truck, Motorhome and Toterhome Customers. We suggest customers look for manufactures who offer the following items listed in the Coach Limited Warranty for Trucks, Motorhomes and Toterhomes.

Coach Limited Warranty For Trucks, Motorhomes and Toterhomes

14) If a customer and/or authorized contractor or manufacturer creates a deal outside of this Bill Of Rights and the authorized contractor or manufacture builds and/or creates the unit, the authorized contractor or manufacturer shall be awarded 0 (zero) compensation. The customer shall receive the unit, either under construction or completed, at no additional cost to the customer. The authorized contractor, vender or manufacturer who breached this agreement shall waive all claims and all legal recourse. Under this contract, the authorized contractor, vender or manufacturer shall pay the legal cost for our companies without objection.

 

15) Any authorized contractor or manufacturer and/or customer whom accept a contract, either directly from The Toy Lot.com or an agent, agrees to these terms unconditionally. The authorized contractor, vendor and or manufacture shall give the customer, a copy of the Bill of Rights at the time of closing. If the authorized contractor, manufacture fails to supply and or review the Bill Of Rights with the The Toy Lot.com, Cowboy Cadillac or RV Truck and the customer. customer when they collect the funding from the customer, the authorized contractor, manufacture shall assume all financial liability and terms listed above without recourse.

 

16) The authorized contractor, Manufacture shall agree to e-mail photos of the The Toy Lot.com, Cowboy Cadillac or Rv Truck and the customer project to cowboycadillac@gmail.com during each week of construction. Photos allow the The Toy Lot.com, Cowboy Cadillac or Rv Truck and the customer. Customer to watch the progress of the construction project. Furthermore this insures the project is on time and being complete within the guidelines listed above. If the authorized contractor, vendor does not e-mail the photos during each week of construction the vendor and or manufacture shall assume all financial liability and terms listed above without recourse.

 

17) The customer shall retain a copy of the signed contract in case of disputes. If the customer has lost a contract or the contract was lost in fire or storm, we shall not replace a copy. Under our agreement we are only required to supply a contract in disputes of a criminal act to a law enforcement agency. When a customer signs a contract they agree to all written statements and waive the right to claim they were unaware of the Bill of Rights.  

18) The Full Coach Limited Warranty established a new standard for Motorhome warranties in 1999, 2008 and 2011; it continues to be the very best, most complete warranty offered in the Motorhome industry. We are happy to provide a complete copy here for you to study and compare with any other Motorhome warranty you choose.

Once you do, we are confident you will recognize the Full Coach Limited Warranty as the kind of protection every Motorhome should have. This warrants the construction for ten (10) years, and sidewall lamination for five (5) years. Each model has its own unique additional set of warranties depending upon its type of chassis, generator, etc.

19) Any authorized contractor, vender and/or manufacturer wanting to benefit from The Toy Lot.com, Cowboy Cadillac or RV Truck and the customer, the label name must agree to all of the following before signing a purchase order and/or contract to construct a unit using The Toy Lot.com label. If the manufacturer objects to any point in the Owner Bill of Rights, it must be stated in writing before work begins. Any objection shall be sent certified mail to the address listed.

Cancellation Policy: 
Once the order has been placed, it cannot be cancelled. The order is considered placed when the contract is signed or a verbal order results in a payment for goods or services. The contract shall be mailed to the address listed on the contract or faxed. Faxed signed contracts are to be considered as original. Orders are considered either written or verbal contracts between a person who contacts either Cowboy Cadillac or DBA RVTRUCK or a person acting on behalf of the owners of said project. Custom one off projects are billed at the rate of $350.00 US DOLLARS per man hour plus transportation and development cost. The hourly rate does not reflect other costs not listed in the user policy. On custom one off projects the customer shall fund the project before work begins. Hauler beds, Toterhomes, Motorhomes, E-Store product seats, wood kit consoles and/or any custom material ordered online or over the telephone or by sales representatives cannot be returned. Custom made parts sold via the e-store may require custom installation by a professional. No returns. No exchanges. No refunds. All sales are final on verbal and written contracts. All sales are final in Texas or at the vender manufacturing such product. Any such product paid to this of any vender is under the laws of that state. Liability is a legal doctrine that makes a person responsible for the damage and loss caused by his/her acts and omissions regardless of culpability of said venders who bid on the conversion. NO Strict liability is a legal doctrine that makes a person responsible for the damage and loss caused by his/her acts and omissions, regardless if culpability is held on Cowboy Cadillac, RV Truck or on any other DBA used by this web site. The vender who bids on and/or completes the conversion holds 100% liability for the action taken on behalf of conversion company’s manufacturing products for the named companies. As to Cancellation Policy, all contracts and legal actions shall fall under the laws of Texas.

For the ethically challenged customers who think they can save money by making a side deal with a company where you are referred or the customer fires Cowboy Cadillac, RV Truck and The Toy Lot.com, said companies shall not be held liable for the referral.  All contracts and legal action shall fall under the laws of Texas.

All export sales are final at time of contract. No refunds or returns on orders from the The Toy Lot.com, Cowboy Cadillac or RV Truck and the customer or E Store or authorized contractors. If a customer funds a unit and the vendor and/or vendors do not complete the unit, the customer can only receive credit for the profit made by our company on future conversions.  All sales are final at time of contract. No refunds or returns on orders. The customer hereby waives any right to legal recourse against The Toy Lot.com, Cowboy Cadillac or RV Truck and the customer and/or authorized contractors. Each customer shall retail a copy of the signed contract. We will not supply copies of any lost contracts after they are signed: keep your contract.

 

Exports

Export dealers or any person based outside of the United States must pay for any truck, motorhome, toterhome or trailer before work begins. If the exporter purchases a unit not built by our contractors, we offer a one time flat fee that is agreed to by the exporter in this Bill of Rights. The one time customer shall totally fund the full cost of consulting firms in both countries.  If the exporter has a unit built for resale buy our contractor, they must place a security deposit to fund the cost of consulting firms in both countries. The exporting customer shall pay the full cost of consulting firms in both countries. The deposit for an exporter is 50% of the total build cost for 6 or more units. This deposit must be received in full before any part of the project begins. The contract shall state the cost of one unit with the agreement. The contract may be changed in a written request before a deposit is received for an order of less than 6 units. That funding shall remain as credit until the exporter sells 6 units over a 2 year period. After the sixth unit is sold, the deposit shall be refunded. If said exporter fails to complete the order the deposit shall be applied to engineering and labor cost, and unpaid commissions. The deposit is non refundable when the exporter fails to complete the order.

If the authorized contractor, manufacturer and/or vender does not object to this Bill Of Rights, the authorized contractor or manufacturer shall comply with each part of this document. Furthermore, the authorized contractor or manufacturer waives all right to legal recourse.

It is the goal at The Toy Lot.com, Cowboy Cadillac or RV Truck and the customer to create an affordable high quality line at factory direct prices. The Toy Lot.com, Cowboy Cadillac or RV Truck and the customer is listed in the N.A.D.A. Buyers Guide. If a customer and/or manufacturer or vendor have any questions, please address the issue before signing a contract.

Cowboy Cadillac is a venue. The authorized contractor is in body The Toy Lot.com, Cowboy Cadillac, RV Truck, or manufacturer.  The authorized contractor waives all right to legal recourse. The customer hereby waives any right to legal recourse against The Toy Lot.com, Cowboy Cadillac or RV Truck .The customer shall collect all deposits and uncompleted conversion and repairs from the authorized contractor. The retail customer and authorized contractor or manufacturer waives all right to legal recourse against The Toy Lot.com, Cowboy Cadillac or RV Truck.
